1. Order processing times

Orders are processed within two business days of receipt. Once “the purchase is completed and the order confirmation email is received”, orders will be processed. Delivery times may vary depending on the chosen product, but never before 2 (two) business days. “Processing may be delayed during holidays. Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. CASCINA SAN GIOVANNI S.S. AGRICOLA is not responsible for unforeseeable delays, provided that, except in cases of force majeure, the Products will be delivered within a maximum period of 20 (twenty) days from the day following the day the Customer placed the order” with CASCINA SAN GIOVANNI S.S. AGRICOLA.

The delivery day will depend on the destination location and the availability of the ordered goods. Deliveries are not made on holidays and the day before holidays.

2. Delivery methods

Product deliveries are made to the address indicated by the Customer during the purchase process through the carrier throughout the Italian territory except for Campione D’Italia and Livigno. The carrier assumes full responsibility for the transport, from pickup at the supplier to delivery at the indicated address. CASCINA SAN GIOVANNI S.S. AGRICOLA assumes no responsibility for any damage or irregular behavior by the carrier.

It is possible to choose the most convenient shipping address: your residence, office, or another person’s address. For the delivery of the goods, the presence of the Customer or their representative is required at the recipient’s address indicated in the order.

No responsibility can be attributed to CASCINA SAN GIOVANNI S.S. AGRICOLA in case of delay in order processing or delivery of the ordered items.

Upon delivery, the customer is required to check:
– that the packaging is intact, not damaged, wet, or otherwise altered, including the sealing materials;
– that the number of packages corresponds to what is indicated in the transport document.

Any damage to the product or packaging or non-compliance with the indications must be immediately contested to the courier by placing a WRITTEN CONTROL RESERVE on the courier’s delivery receipt. Once the courier’s document is signed, the Customer cannot make any objection regarding the external characteristics of the delivered items.

In case of non-collection within 5 business days of the material held in the courier’s warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the order will be canceled.

If any product presented on the portal is no longer available or for sale at the time of completing the purchase operation, CASCINA SAN GIOVANNI S.S. AGRICOLA will communicate the inconvenience within 15 (fifteen) days from the day following the transmission. If the Customer has already paid for the order, CASCINA SAN GIOVANNI S.S. AGRICOLA will provide a full refund of the amount as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order. For security reasons, deliveries will not be made to P.O. boxes, and the order will not be processed.

3. Payment methods

For each order placed, CASCINA SAN GIOVANNI S.S. AGRICOLA issues a sales document for the shipped material. For the issuance of the invoice, the information provided by the customer at the time of the order is valid. The Customer can request a copy of the invoice or fiscal receipt within three months from the issuance.

Delivery costs are borne by the Customer and are indicated at the time of order placement unless clearly provided otherwise in the sales offer.

All prices on the site are intended as public prices and, therefore, inclusive of VAT. Prices may change without notice, and the only correct price is the one indicated at the time of order confirmation.
For certain products subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to communication and acceptance by the customer, failing which the order will be considered canceled.

In cases of purchasing goods with the “credit card” payment method, at the same time as the online transaction is completed, the reference bank will authorize only the commitment of the amount related to the purchase made.

Upon request, an invoice for the shipped goods can be issued to the order holder, pursuant to D.P.R. 445/2000 and D.L. 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No changes to the invoice will be possible after its issuance.

The shipment of goods takes place only after the acceptance of the order and receipt of payment.
In case of order cancellation, either by the Customer (for the reasons stated in the following point 4B) or in case of non-acceptance by the seller for reasons not attributable to their will, the order will be canceled, and the committed amount will be released (the release times depend exclusively on the banking system). Once the transaction is canceled, the seller cannot be held responsible for any damages resulting from the release of the committed amount by the banking system.

CASCINA SAN GIOVANNI S.S. AGRICOLA reserves the right to request additional documents from the Customer proving the ownership of the credit card. In the absence of sending the documentation, CASCINA SAN GIOVANNI S.S. AGRICOLA reserves the right not to accept the order.
Transaction security is guaranteed by a data encryption system (SSL) and direct, protected, and certified connections.

4. Withdrawal legal guarantee

A. Legal guarantee

The purchased products are always accompanied by a legal guarantee covering manufacturing defects.
The legal guarantee cannot be claimed by those who purchased the products as part of their business or professional activity, indicating their VAT number.
The legal guarantee entitles you to request from CASCINA SAN GIOVANNI S.S. AGRICOLA the replacement of the item, free of charge, provided that the requested solution is not impossible or excessively burdensome, considering: the extent of the defect, the value of the defect-free product, and the possibility that the alternative can be implemented without significant inconvenience to the Customer;
if repair or replacement is impossible, excessively burdensome, or delayed, or causes significant inconvenience to the Customer and is not effective in resolving the problem, the Customer has the right to request a price reduction. In determining the amount of the reduction, the use of the item must be taken into account. In any case, for minor defects for which it was not possible to replace the product, the contract cannot be terminated.
The seller replaces the product within a maximum of 30 days from delivery.
To enforce the guarantee, the Customer must by law:
– keep and present the purchase receipt;
– report the defect within seven days of its discovery;

B. Right of withdrawal

CASCINA SAN GIOVANNI S.S. AGRICOLA reserves the right not to accept goods from the same order, returned and shipped at different times. The return shipping costs will be borne by the customer, including responsibility in case of loss or damage to the products.

If there is no correspondence between the recipient of the products indicated in the order and the person who made the payment of the amounts due for their purchase, the refund of the amounts, in case of withdrawal, will be made to the person who made the payment.

The online customer acting as a consumer is granted the right to withdraw from the contract, as provided by Articles 64 – 67 of Legislative Decree no. 206/2005, known as the Consumer Code.
It should be noted that this right is reserved only for natural persons, i.e., private consumers acting for purposes unrelated to their profession. There is no right of withdrawal for legal and natural persons acting, in reference to the purchase contract, in a professional context.

Pursuant to and within the limits of Article 64 of the Consumer Code, the consumer has the right, within 14 calendar days from receipt of the purchased products, to exercise the right of withdrawal, consisting of the possibility of returning the received products and obtaining a refund of the price paid, without penalty and without the need to specify the reason.

This right applies to all products purchased online on this site.
The return shipping costs are borne by the consumer.

The right of withdrawal is completely void if the returned product is not intact, due to the absence, for example, of integral elements of the product or because the product has been damaged for reasons other than transport from the Seller to the consumer, not previously reported.
Without limiting the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse the delivery or accept it with express reservation.

Each collection of intact packages must be carried out by the customer by placing the wording “INTACT PACKAGE, COLLECTION WITH CONTENT CONTROL RESERVE” on the appropriate accompanying document (art. 1698 Civil Code). Any anomaly must then be communicated within eight days.

Procedure to exercise the right of withdrawal

To exercise the right of withdrawal, it is necessary to send, within 14 calendar days from receipt of the purchased product, a communication clearly expressing the intention to withdraw from the purchase contract.
This communication must be sent by registered letter with acknowledgment of receipt.

The communication can also be sent, within the same period, by telegram (to the company’s address).

The consumer must then arrange, using a courier of their choice, for the shipment of the product (if possible in the original packaging and, in any case, always carefully packed) and all originally contained items.
The consumer must make this shipment within fourteen working days from the date on which they sent the communication of exercise of the right of withdrawal.

Important notes

The transport costs and the responsibility for the goods during shipment, as provided by law, are borne by the consumer.
It is therefore advisable to insure the product with the chosen courier, taking care to pack the goods carefully, where possible inserting the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any guarantees. In case of transport damage occurring during the return, CASCINA SAN GIOVANNI S.S. AGRICOLA will notify the consumer of the damage within five working days from receipt of the product, allowing the consumer to file a complaint with the courier used for transport. The damaged goods will be made available for return, and the withdrawal request will be simultaneously canceled. Except as provided below for the case of partial withdrawal, CASCINA SAN GIOVANNI S.S. AGRICOLA will refund, within 14 calendar days from the moment CASCINA SAN GIOVANNI S.S. AGRICOLA becomes aware of the exercise of the right of withdrawal, the entire amount of the purchase and the transport costs for delivery, through a reversal procedure on the credit card or by bank transfer to the current account indicated by the consumer; the transport costs for returning the product remain the responsibility of the latter.

If the withdrawal is partial (i.e., it concerns only part of the products delivered with a single delivery), the refund of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.

Order Cancellation Request

The purchase order can be canceled entirely if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; in this case, no cost will be charged to the Customer. If at the time of the cancellation request the purchase order the product has already been entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to CASCINA SAN GIOVANNI S.S. AGRICOLA.
To this end, it is necessary to follow the procedures indicated above for exercising the right of withdrawal.

Each User is prohibited, either for themselves or on behalf of someone else:
– to use the site of CASCINA SAN GIOVANNI S.S. AGRICOLA for illegal, illicit, or unauthorized purposes or that may harm any third-party rights, including industrial/intellectual property rights, privacy rights, etc.;
– impersonate others’ identities, hide their identity, or provide directly or indirectly false information;
– carry out propaganda, sponsorship, advertising activities through the Portal or that have, even indirectly, professional commercial purposes;
– copy, modify, alter in any way any section of the site of CASCINA SAN GIOVANNI S.S. AGRICOLA; cause harm to third parties or other Users.
